1. ABOUT THESE TERMS

These Terms govern your use of the Find Your Doctor mobile application as a patient. By creating an account and using the app, you agree to these Terms. If you do not agree, please do not use the app.

2. WHAT FIND YOUR DOCTOR IS

Find Your Doctor is a technology platform that connects you with independent, HPCSA-registered healthcare practitioners for virtual (video) consultations. Find Your Doctor is not a medical practice and does not provide medical advice, diagnosis or treatment. The practitioner you consult is solely responsible for the clinical care they provide.

3. NOT FOR EMERGENCIES

The app is not for medical emergencies. If you are experiencing a medical emergency, phone 10177 (ambulance), 112 from a mobile, or go to your nearest emergency department immediately. Do not use a virtual consultation for emergency care.

4. ELIGIBILITY AND YOUR ACCOUNT

You must be 18 or older to hold an account (a parent or legal guardian may book on behalf of a minor and is responsible for that booking). You must provide accurate information, keep your login details confidential, and are responsible for activity on your account.

5. VIRTUAL CONSULTATIONS AND THEIR LIMITS

Virtual consultations are suitable for many, but not all, health concerns. The practitioner may determine that your condition requires an in-person examination and may decline or end a consultation and refer you elsewhere. Any optional health information you provide before a consultation is indicative only and is not a medical device or a diagnosis.

6. YOUR MEDICAL INFORMATION

Information you provide (medical history, allergies, medication, documents) helps the practitioner care for you. You choose what to share, and you can control sharing in Privacy & Sharing settings. Please keep it accurate and up to date, as clinical decisions may rely on it.

7. RECORDINGS AND CONSENT

A consultation may be recorded only where both you and the practitioner consent. Recordings and any clinical notes form part of your health record and are handled in line with our Privacy Policy and applicable law.

8. PRESCRIPTIONS

A practitioner will only issue a prescription where clinically appropriate, at their sole discretion. Certain medicines cannot be prescribed in a virtual consultation. A prescription is issued by the practitioner, not by Find Your Doctor.

9. FEES AND PAYMENT

The consultation fee is set by the practitioner and shown to you before you confirm a booking. A service and payment fee (currently 3.9% plus R1) is added to the consultation fee to cover payment processing, and the full amount is shown to you before you pay. Payment is handled as set out in the Patient Payment Terms.

10. CANCELLATIONS AND NO-SHOWS

You may cancel before the scheduled time in line with the cancellation rules shown at booking. If a practitioner does not attend, you are entitled to a full refund. If you do not attend without cancelling, the consultation may be treated as completed.

11. ROLE OF FIND YOUR DOCTOR

Practitioners are independent contractors, not employees or agents of Find Your Doctor. We do not control or interfere with clinical judgement and we make no warranty about the outcome of any consultation. Your relationship of care is with the practitioner.

12. ACCEPTABLE USE

You agree not to misuse the app, impersonate others, upload unlawful content, or attempt to disrupt the service.

13. LIABILITY

To the maximum extent permitted by law, Find Your Doctor is not liable for the clinical care provided by practitioners or for indirect or consequential loss. Nothing in these Terms limits liability that cannot be limited by law.

14. PRIVACY

Your personal and health information is processed in line with our Privacy Policy and the Protection of Personal Information Act (POPIA).

15. CHANGES

We may update these Terms from time to time. Material changes will be notified in the app. Continued use means you accept the updated Terms.

16. GOVERNING LAW AND CONTACT

These Terms are governed by the laws of the Republic of South Africa. Questions: support@findyourlocum.co.za.

1. WHAT YOU PAY

You pay the consultation fee set by the practitioner plus a service and payment fee (currently 3.9% plus R1) that covers payment processing. The full amount is shown to you before you confirm the booking. All amounts are in South African Rand (ZAR).

2. HOW YOU CAN PAY

• Card / Instant EFT (Paystack): processed securely and confirmed immediately.

• Manual EFT: you upload proof of payment, which an administrator verifies before the booking is confirmed.

• Medical Aid: where offered, subject to your scheme's rules and any pre-authorisation. Amounts your scheme does not cover remain payable by you.

3. WHEN YOUR BOOKING IS CONFIRMED

For card/Instant EFT the booking is confirmed on successful payment. For manual EFT it is confirmed once your proof is verified. Until then the slot is held as pending.

4. REFUNDS

• If the practitioner does not attend, you receive a full refund.

• If a consultation cannot proceed due to a technical failure on our side and cannot be rescheduled, you receive a full refund.

• Patient-initiated cancellations are refunded according to the cancellation window shown at booking. No-shows without cancellation are generally not refundable.

Approved refunds are made to your original payment method where possible.

5. MEDICAL AID CLAIMS

Any claim to your medical scheme is a matter between you and your scheme. Find Your Doctor does not guarantee cover or reimbursement.

6. RECEIPTS AND SECURITY

A record of each payment is available in the app. Card details are handled by our payment processor (Paystack); Find Your Doctor does not store your full card number.

These Terms govern your use of Find Your Doctor as a healthcare practitioner ("Doctor"). By registering and offering consultations, you agree to these Terms.

2. THE PLATFORM

Find Your Doctor is a technology platform that connects you with patients for virtual consultations and facilitates scheduling, payments and record-keeping. Find Your Doctor does not practise medicine and is not responsible for the clinical care you provide.

3. ELIGIBILITY AND VERIFICATION

You must be currently registered with the Health Professions Council of South Africa (HPCSA) (or the relevant statutory body) and in good standing. You must complete verification (KYC), including submitting your HPCSA registration and identity/practice documents. We may verify, and may suspend access where verification cannot be completed or your registration lapses.

4. PROFESSIONAL RESPONSIBILITY

You are solely responsible for your clinical decisions, diagnoses, prescriptions and records. You will practise within your scope, in line with HPCSA ethical rules and telemedicine guidelines, and will maintain your own professional indemnity cover.

5. AVAILABILITY AND CONSULTATIONS

You control your availability and fees. You will attend booked consultations on time, or cancel with reasonable notice. Where a virtual consultation is clinically inappropriate, you will advise the patient and refer appropriately.

6. RECORDS, RECORDINGS AND CONSENT

You will keep appropriate clinical records. Recording only occurs with the consent of both parties. You will handle patient information confidentially and lawfully.

7. FEES AND PAYOUTS

You set the consultation fee. Find Your Doctor deducts a single platform fee (currently 10%) from your consultation fee at payout. There is no separate card or EFT processing fee charged to you. Your net payout and the payout method are as set out in the Doctor Payment Terms.

8. TAX

You are responsible for your own tax obligations arising from payouts.

9. INDEPENDENT CONTRACTOR

You are an independent contractor. Nothing in these Terms creates an employment, partnership or agency relationship with Find Your Doctor.

10. DATA PROTECTION

You act as a responsible party for the patient health information you process in the course of care and will comply with POPIA and HPCSA confidentiality requirements. Find Your Doctor provides the platform and processes information as described in the Privacy Policy.

11. SUSPENSION AND TERMINATION

We may suspend or terminate your access for breach of these Terms, loss of registration, patient-safety concerns, or unlawful conduct.

12. LIABILITY

To the maximum extent permitted by law, Find Your Doctor is not liable for your clinical care or for indirect or consequential loss.

1. YOUR EARNINGS

You set the consultation fee. From it, Find Your Doctor deducts a single platform fee (currently 10%) at payout. There is no separate card or EFT processing fee charged to you. Your net payout is the consultation fee less the platform fee. All amounts are in ZAR.

2. HOW PATIENTS PAY

Patients pay by card/Instant EFT (Paystack), by manual EFT (verified by an administrator), or by medical aid where offered. A consultation is payable to you once payment is confirmed (or the EFT proof is verified).

3. PAYOUTS

Payouts are made to the banking details on your verified profile. Keep them accurate and current. Payout timing may depend on payment method and verification.

4. TAX

You are responsible for your own tax, including any VAT that may apply to your services.

5. CHARGEBACKS AND DISPUTES

Where a payment is reversed, charged back or found to be fraudulent, the corresponding amount may be deducted from or offset against your payouts.
